This Privacy Policy applies to the collection, storage, use and disclosure of personal information by Evinact (collectively “Evinact”, “us” or “we”) including personal information collected via our website evinact.com (this site).

Evinact is committed to privacy best practice. We are bound by the Privacy Act 1988 (“the Act”) which means we follow the Australian Privacy Principles when we handle personal information.

We will only collect, use or disclose personal information in accordance with the Act and this Privacy Policy. By submitting personal information, you consent to Evinact’s use of such personal information as described herein. Collection of personal information

Evinact collects personal information when users register for evinact.com newsletters and alerts, sign up for conferences and events, provide digital contact details or participate in forums (such as bulletin boards, discussion forums). For recruiting purposes, the information collected may include personal information that you include on your resume and information that you submit as part of your application.

In addition, we use Google Analytics to analyse non-identifiable website traffic to improve our service. This includes information that you do not visibly enter, such as your Internet Protocol (IP) address, browsing pattern on the site, click stream data, HTTP or HTTPS protocol elements, and the status of cookies placed on your computer by Evinact.

Limiting information collection

We will only collect personal information if:

  • it is for a lawful purpose that is directly related to one of our functions, and
  • it is reasonably necessary for us to have the information.

Use and/or disclosure of personal information

Evinact may use your personal information to provide a service, fulfil your requests for information, publish your comments, process your requests to participate in conferences and events, evaluate any job applications, for its own internal recruiting purposes, distribute newsletters and alerts to you, and for such other purposes as you may initiate or request. By registering for recurring Evinact newsletters or alerts or providing your contact details via a digital business card, you agree to receive on occasion other correspondence from Evinact.

Use of cookies

Cookies are small packets of information that are stored by your web browser to improve your browsing experience. They are put on your web browser by the websites that you visit. These packets of information do not contain personal information about you, but they do allow us to know if you visit the same website twice or if you visit related websites.

Evinact uses cookies to identify your interests and to track your use of our site. We also use cookies to control access to certain content on our site and to process any requests that you make with us.

Use of third parties

To administer our website and for research purposes, Evinact contracts third parties to track and analyse anonymous usage and volume statistical information from our visitors. Such information is shared externally only on an anonymous, aggregated basis. These third parties use persistent cookies to help us to improve the visitor experience, manage our site content, and track visitor behaviour.

Evinact also uses third parties for our digital business cards and to send e-mails to registered parties. To help measure and improve the effectiveness of our e-mail communications, the third-party email service sets cookies. All data collected by third parties on behalf of Evinact is used solely by or on behalf of Evinact.

Evinact shall not intentionally disclose or transfer (and shall take reasonable steps to prevent the unauthorised or accidental disclosure of) your personal information to third parties (i.e., persons or entities that are not affiliates of Evinact) without your consent, except as follows.

  • Evinact may provide access to your personal information to third party vendors engaged by Evinact to provide services related to the site; provided that such vendors first agree to maintain the strict confidentiality of such information and provide the same level of data security as provided by Evinact.
  • Evinact may be compelled to surrender personal user or customer information to legal authorities without express user consent if presented with a court subpoena or similar legal order, or as required or permitted by the laws, rules, and regulations of any applicable jurisdiction.
  • In the event of a violation of the Terms of Use of or any other terms on this site, including but not limited to a violation of any restrictions on use of materials provided in or through this site, Evinact may disclose personal user information to affected parties and legal authorities in furtherance of potential or on-going legal proceedings.

Link to third-party sites

Evinact may provide links to third-party websites or information as a service to our users. If you use these links, you will leave the Evinact site. Such links do not constitute or imply an endorsement, sponsorship, or recommendation by Evinact of the third party, the third-party website, or the information contained therein, and Evinact shall not be responsible or liable for your use thereof. Such use shall be subject to the terms of use and privacy policies applicable to those sites.

Security

Evinact has implemented generally accepted standards of technology and operational security in order to protect personal information from loss, misuse, alteration, or destruction. Only authorised Evinact personnel and approved third party vendors are provided access to personal information, and these employees and vendors are required to treat this information as confidential.

Transborder hosting of information

The personal information that we collect is mainly stored in data centres located in Australia. However, we do use the following third-party services which may host data outside of Australia:

  • Hubspot email service for newsletters and event invitations. HubSpot data is stored in data centers in the United States, Canada, Australia, and the European Union. The data centre is assigned based on the IP address of the user at the time of sign-up. Eventbrite is also used for event invitations. Eventbrite physically stores personal data in the United States and take legally required steps to make sure that appropriate safeguards are in place to protect individuals’ personal data in the course of cross-border transfers to U.S.-based servers.

Both organisations use physical, technical and organisational safeguards designed to protect personal information. However, despite these controls, Evinact cannot completely ensure or warrant the security of your information. For this reason, the information collected is very limited.

Data Retention Policy

Evinact stores personal information for various purposes as per other sections of this policy. For each of these different purposes, Evinact retains the personal information for the legal retention period and/or as long as it is serving its notified purpose. Further details about our retention and disposal practices are available upon request.

Rights and choices

You may access, correct, update, and/or delete any personal information that you submit to this site. You may also unsubscribe from mailing lists or any registrations on the site. To do so, either click ‘unsubscribe’ in the last email we sent you or contact our Privacy Officer.

You can also withdraw your consent for any of the collection purposes outlined in this policy. By withdrawing consent, you may limit the services and information provided to you.

Complaints

If you have any questions or concerns about our collection, use or disclosure of personal information, or if you believe that we have not complied with this Privacy Policy or the Act, please contact us as set out below. The Evinact Privacy Officer will investigate the complaint and determine whether a breach has occurred and what action, if any, to take. When contacting us, please provide as much detail as possible in relation to the query, issue or complaint.

We will take any privacy complaint seriously. We will aim to resolve any such complaint in a timely and efficient manner, and our target response time is 15 working days.

We expect our procedures will deal fairly and promptly with your complaint. However, if you remain dissatisfied, you can also make a formal complaint to the Office of the Australian Information Commissioner (which is the regulator responsible for privacy in Australia):

Consent; changes to privacy policy
